TCA Legal Battle
As you know from a previously published article on the NYSCA website, there is an ongoing legal battle between the Texas Chiropractic Association (TCA) and the Texas Medical Association (TMA). This legal battle has challenged the very basis of Chiropractic and what Chiropractors can do in Texas.
At present, due to a court ruling, it exceeds a Chiropractor’s scope of practice to make medical diagnosis and perform other medical procedures. The court specified that, as outlined by the Texas Board of Chiropractic Examiners (TBCE), the definition of “musculoskeletal system” to include “nerves,” the definition of “subluxation complex” as a “neuromusculoskeletal condition,” as well as the use of the term “diagnosis” all EXCEED the scope of Chiropracticas defined by the Texas Occupations Code.
Fortunately, while an appeal is waiting to be heard, there is no change in how DCs analyze, examine, or evaluate their patients, nor the manner in which they improve the subluxation complex or treat the biomechanics of the musculoskeletal system.
Both the TCA and the TMA have indicated that, whatever the outcome of this latest ruling, they have always intended to take this case to the Texas Supreme Court for a final decision. One thing is certain -- this will be an expensive appeal process as this case winds its way through the Court of Appeals and to the Texas Supreme Court.
We must keep in mind that what happens in one state could also affect other states. That is, what happens in Texas could ultimately happen in New York. The NYSCA has already needed to ward off several small attacks directed at this very issue, since Texas and New York have very similar practice parameters.
Our efforts towards Scope Modernization are extremely important to help us thrive and to protect the Profession and livelihood of Chiropractic in New York State for future generations. However, this is a long term goal and one that will take determination, strength, endurance, and yes, lots of funding. So, please be proactive and support your Association and the New York Chiropractic Political Action Committee (NYCPAC).
Support your PAC
NYCPAC is the political action committee of the New York State Chiropractic Association and is intended to help elect state officials who are pro-Chiropractic.
Organized medicine, managed care organizations and other anti-Chiropractic forces continue to spend hundreds of thousands of dollars each year to elect candidates that do not value the Chiropractic profession. NYCPAC provides us with a great opportunity to support pro-Chiropractic candidates. NYCPAC also provides ongoing support to pro-Chiropractic legislators.
It is important to support your PAC and the fight in Texas. We must align our thinking with the famous Scottish social activist and philanthropist Patrick Geddes, who believed in working with the environment and not against it.
“Local character is thus no mere accidental old-world quaintness, as its mimics think and say. It is attained only in course of adequate grasp and treatment of the whole environment, and in active sympathy with the essential and characteristic life of the place concerned."
The NYSCA is carefully monitoring events in Texas and offers its support to their chiropractic brothers and sisters in Texas. At the convention, the NYSCA was able to raise over $2,300 for the TCA to put toward their legal defense. The NYCPAC was also able to raise over $4,800 through generous contributions. Unfortunately, these numbers are paltry when compared to the numbers that adversaries of the Chiropractic profession have in their possession.

Skip the expensive cup of coffee once a week or dine out one less time per month. Give to NYCPAC and help our brothers and sisters in Texas. Their future, and ours, depends on it.
